KY Archives Criminal and Civil File 238 April 26, 1831 Pike Circuit Court} Sct James Rutherford complains of George Hatfield being in custody of a pleas of trespass - for that the defendant heretofore to wit on the _ day of 18__ at the circuit aforesaid with force and arms to wit with sticks, swords, stones and there bruise and beat down the plaintiff and ill treat him the said plaintiff and did then and there ill-treat & abuse the wife and family of him the said plaintiff to wit at the circuit aforesaid and many other wrongs to the plaintiff then and there did against the peace and dignity of the commonwealth. To the damage of the plaintiff of two hundred dollars and therefore he sues.   Answer} the defendant by his attorney also say action now before he says that he is not guilty in manner & there as the plaintiff has complains of him accept as to the entry of the plaintiff chose _ use against the peace and dignity of the commonwealth as allege against the deft the plaintiff and of this he puts himself upon the country.   We James Rutherford principal _ Rubin Rutherford his security to bind ourselves three months after the date hereof to pay George Hatfield the plaintiff on execution the sum of $ being the amount of the last of an execution which said from the clerks office of the Pike Circuit Court the 30th January 1832 in favor of George Hatfield for the sum of $2.18 cost of suit 50 cents for half this bond and moiety in the whole to the sum of $2.71 aforesaid against said James Rutherford & the said James Rutherford. Ruben Rutherford his surety have leave here by replied the same the above bond and interest from the date given and our bond this 18th day of Feb 1832. Jas. Rutherford, Ruben Rutherford   The commonwealth of Kentucky to the sheriff of Pike County greetings - you are hereby commanded you to take George Hatfield of he be found in your bailiwick and keep him safely so that you leave him before the Judge of the Pike Circuit Court at the court house in the town of Pikeville on the first day of our next July Term to answer James Rutherford and Sally his wife & a plea of trespass _ damages $200 and have then them this _ witness James Honaker clerk of our said Court at Pikeville this 28th day of April 1831 and in the 39th year of the Commonwealth. He meaning the Plaintiff had had intercourse with his yellow mare and got her with foals. This meaning the Plaintiff was guilty of the crime of bugery to the damage of the Plaintiff of five thousand dollars. He further states that the said Defendant (unreadbale line) Court recover Judgment against Elixious Hatfield for the sum of $32.55 and also against the Plaintiff for the sum of $61.25 which last amount is now in the hands of S.K. Damron clerk of said Court per petition states that the Defendant Stafford has said conveyed or otherwise dispersed of his property or _ or permitted it to be sold with the fraud set and interest to what hinders and delay his creditors in the collection of their debts or is _ to sell as he believes, or convey or otherwise dispose of his property with such interest & he asks that an attachment issue against the Defendants property and prays Judgment for five thousand dollars in damages and all proper relief. Damron holds money for him under any direction of his - in that he holds the same as a bond in Court - he denies that any cause for issuing attachment existed - he says he does not sell convey or otherwise dispose of his property in or permitted it to be sold with the fraudulent intent to hinder and delay his creditors in the collection of their debts - as is about to sell or convey or otherwise disprove of his property with such intent - he says the said charges are false and untrue. Please state if you were present and heard a quarrel or dispute between George Hatfield and Fleming Stafford if so state what you heard and was and when it was and who was present? A. I was present and heard a Felming Stafford in October 1857 near Asa McCoy on the Back Bar of the river in Logan County Virginia and I think Aliphar McCoy, John Sansom, Lias Sansom, & Andrew McCoy.   By same to same} Q. Please state if in said quarrel the Defendant charges and published a foul offense upon the Plaintiff if so state what it was? A. I did hear Stafford use foul and slanderouse language to George Hatfield.   By same to same} Q. Please state as well as you can remember the precise words used by Defendant in said conversation? A. I did hear him say; Yes, God Dam you, I saw you down in the your field on your old yeller mare a fucking her. Same to same} Q. Please state if you was acquainted with the general moral character of the Plaintiff before the bringing of this suit if so state that character was good or bad? A. I was acquainted ever since I can recollect and his character was very good so far I know or heard. William McCoy Jr. (Jacob Smith was the examiner for County Court)   Caption The depostion of Anderson Ferrell and Wm McCoy taken on Saturday the 15 day of October 1859 at the store house of Dils and Smith in Pike County taken to be read as evidence in an action between George Hatfield plaintiff and Fleming Stafford defendant pending in Pike Circuit Court. Anderson Ferrell sworn deposthe as follows; Q. Please state if you were present and heard a quarrell and dispute between George Hatfield and Fleming Stafford if so state where it was and when it was and who was present? A. I was present & heard a quarrel between Mr. Hatfield & Stafford near Asa McCoys on and of the river the Rock Bar in Logan County Virginia about October 1857 & John Sansom and Alephar McCoy & some others were present but I don't recollect who all were present. Q. Please state if in said conversation did defendant charge and publish a slanderouse offence against the plaintiff if so state what it was? A. I did hear Fleming Stafford use very foul and vulgar language to George Hatfield in said quarrel. By same to same Q. Please state if you was acquainted with the general moral character of the plaintiff before bringing of this suit if so state whether it was good or bad? A. I was acquainted ever since I can recollect and I never heard anything disrespectful of the plaintiff. Anderson Ferrell   Pike Circuit Court George Hatfield plaintiff against Fleming Stafford defendant} This affiant Fleming Stafford says it is not true as set forth in plaintiffs petition that he had sold convey or otherwise dispose of his property or presented it to be sold and is fraudulent intent to cheat hinder and delay his indebtors in the collection of their debts or who is about to sell or convey or otherwise dispose of his property with such intent. Stafford this 21 day of May 1860.   The Commonwealth of Kentucky To the sheriff of Pike county greetings You are commanded to summon William Pruitt, John Sansom & Elixous Evens to appear before the Pike Circuit Court, on the 3rd day of April term, to testify in behalf of Defendant in an action in said Court between George Hatfield Plaintiff and Fleming Stafford defendant. 22nd day of March 1859.   May 21, 1860 - Pike Circuit Court Geo. Hatfield Plaintiff vs. Fleming Stafford Defendant.} The defendant excepts to the reading of the depositions of Anderson Ferrell and Wm. McCoy 1st because there no good & sufficient notice - the same was not executed as required by law - that Daniel McCoy who certifies he wrote a true copy on the defendant door cannot write or read writing.   Mr. Fleming Stafford, Sir, take notice that on Saturday the 15th day of 1859 at the store house of Dils and Smith at the mouth of Pond Creek Pike County Kentucky, I shall proceed to take the depositions of Anderson Ferrell and others (and of said depostions are not completed on the day aforesaid I will continue from day to day until completed to be read as evidence in an action wherein I am plaintiff and you defendant now pending in the Circuit Court of Pike County Kentucky at which time and place you may attend if you see proper Oct 11th 1859. Their is a person who would like to link the two suits, but clearly if someone was going to beat somone up over slander, why wait two years. These are two separate causes. This case is on the onset of the civil war, and may have had more to do with that than a slander case.   KY Archives Criminal and Civil Case File 1889 Aug 22, 1960 [sic 1860?] Pike Circuit Court Flemmon Stafford Plaintiff against Madison Hatfield, Anderson Hatfield Defendant} Petition The plaintiff Flemmon Stafford states that the defendants Madison Hatfield and Anderson Hatfield on the _ day of _, 1860 unlawfully entered on the premises of the plaintiff in Pike County - entered into his house and with force and arms assaulted him, tied him, forced him from his house into the public highway and along the same for _ miles to the great terror of his life and his disgrace wherefore he prays judgment for the unlawful assault and battery for the sum of one thousand dollars and all appropriate relief. Brown   Pike Circuit Court June 28, 1860 F. Stafford Plaintiff against Madison Hatfield & c Defendant} Answer The defendant Anderson Hatfield for answer states that it is not true that he did on the _ day of 1860 unlawfully entered on the premises of the plaintiff in Pike County. He denies that he entered into the house of plaintiff & with force and arms assaulted & tied the plaintiff & forced him from his house into the public highway and along the same for _ miles to the great terror of the plaintiff. He denies committing on or any of said grievances complained of by plaintiff. Wherefore he prays judgment & relief. The defendant for further answer states that on the day _ of 1860 the plaintiff did unlawfully assault & beat the defendants father George Hatfield, that after the __injuring should have been committed by this defendant, the said George Hatfield & the plaintiff did agree to & actually did compromise & accord all the difficulty & course of action existing between the said George Hatfield & all the members of his family including this defendant in consideration of said George Hatfield not being the plaintiff for the assault & battery committed by him on said George Hatfield the said George Hatfield did not but the plaintiff by notice of said agreement by the plaintiff is in violation of said accord & satisfaction prosecuting in for of this suit. Wherefore he prays judgment of dismissal & for other proper relief. Anderson Hatfield   Pike Circuit Court Oct 7, 1860 F. Stafford Plaintiff against Bazzell Hatfield, Valentine Hatfield (Big Ephs son), Anderson Hatfield (Big Ephs son) Defendant} Petition The plaintiff Flemmon Stafford states that on the _ day of 1860 the deft Bazzell Hatfield, Valentine Hatfield, and Anderson Hatfield in together with George Hatfield, Daniel Christian, Madison Hatfield, James Hatfield, Ransom Hatfield unlawfully assaulted the plaintiff with rocks, guns, & knives in the presence of his family and tied him, forced him out of his house to his great terror and disgrace away from his family of children along the public highway and so kept him tied for the assault of him for said unlawful assault and battery, he prays judgment for one thousand dollars and all appropriate relief. Stafford Plaintiff against Bazzell, Valentine, Anderson Hatfield Defendant} Answer of Bazzell & Anderson Hatfield The above Bazzell and Anderson Hatfield for answer to the pltf petition says that it is untrue that they assaulted the pltf or committed any trespasses set forth in the said petition. They further state that the pltf should not have & maintained his said cause of action because on the plaintiff did on the _ day of 1860 unlawfully assault & beat these defendants father George Hatfield & after commit on the day of _ 1860 & subsequent to the commission of the alleged assault and battery of these deft on the pltf the said George Hatfield & the plaintiff agreed to talk all the difficulties existing between the plaintiff and said George Hatfield & this family including the defendants the said George Hatfield agreed to and the plaintiff for his said assault & battery on him if the plaintiff would not prosecute this action or any other causes of action. He then might have against these defendants & they then settled the whole of this difficulty including the pltf cause of action herein & according to this against the said being Hatfield did not suit the plaintiff for the assault and battery committed on him. Yet in violation of said agreement the pltf is now prosecuting this suit. He pleads this settlement as accord and satisfaction of the pltf alleged cause of action herein & pleads & rules upon it in for of this action. B&A Hatfield   Mr. Fleming Stafford, Sir, take notice that we shall on Tuesday the 23 day of October 1860 at the office of Warren M. Alderson Justice of the Peace for Logan County Va., proceed to take the deposition of John (?) and others and shall from days to be read as evidence in behalf of the defendant in the following suits. Fleming Stafford against George Hatfield, Daniel Christian, James Hatfield, Bazzell Hatfield, Valentine Hatfield, Anderson Hatfield, same against Madison Hatfield and Anderson Hatfield.   The deposition of J.W. Stafford taken on this 23rd of Oct 1860 at the Office of Warren M. Alderson Justice of the Peace for Logan County Va., to be read as evidence in this cause follows. Q. Please state Mr. Stafford what is your age and occupation and where you reside. A About 27 years old, live in Logan County Va., clerking in the store as my occupation. Q You will please state if you were present at as seen the store of Mr. Alderson where a difficulty occurred between Mr. Fleming Stafford and George Hatfield. A It happen in Logan County Va., I am a nephew of Fleming Stafford and further this deponent sayeth not. John M. Stafford.   [Page missing - Don't know who gave this deposition] If so state where it was a near as you can, and also what Mr. Fleming Stafford done and said on that occasion, tell all about it as near as you can. I was present the precise time I cannot tell but I think it was sometime in the first of last June. I don't know how the difficulty first come up. I heard Stafford tell Hatfield that he had got more on the right side of the river, Stafford called Hatfield for an old yellow hide devil to not _ him or he would blow a ball threw him. Hatfield started up the road towards home and afterwards I saw Stafford follow him with his gun. Shortly after Stafford left, I saw Hatfield's horse coming back and Hatfield not on the horse. I started up the road to see what had become of Hatfield and met him coming back, he appeared to be hurt and said he was hurt and that Stafford knocked him off his horse with a rock. I went up to the ford with Mr. Hatfield and saw where I suppose Stafford had knocked Mr. Hatfield off of his horse it looked like a man had fallen there. You will please state where all this happened and also what relative you are to Fleming Stafford.   Pike Circuit Court F. Stafford against George Hatfield} Answer The defendant Ransom Hatfield for answer states that it is not true that he did on the day of 1860 in the county of Pike or elsewhere or unlawfully assaulted beat or maltreated the plaintiff. He denies being guilty of beating or maltreating the pltf in an unlawful manner. Wherefore he prays Judgment. 2 For further answer the defendant states that the plaintiff ought now to have & maintain his action because on the day of _ 1860 the plaintiff did unlawfully assault & beat this defendants father George Hatfield and in consideration of said George Hatfield not suing the plaintiff for said assault and batter the plaintiff did on the _ day f 1860 & subsequent to the alleged by this defendant agree up all causes of action that the then had against this defendant & all the member of said Hatfield family - the pltf & the same George Hatfield did then & there mutually agree not to sue each other & this deft did attempt in sais accord the plft right to prosecute this suit & the said George Hatfield did not sue the plaintiff for the said assault & battery committed on him by the plaintiff yet in violation of this accord & satisfaction the pltf is now persecuting this suit he _ upon sais accord & satisfaction as a bar to this suit. Wherefore he prays judgment to be dismissed for all other proper relief.
